Kamduni case is prosecuted(!),,, yes only at the lower court although!
Now, starts the usual rigmarole of a long drawn skit [not natak but nautanki to
be precise]. This drama might take anything between 5 to 20 years , depending
upon the sweet wishes of the rulers, the class position with a counterpoint of
peoples’ movement as a wedge, the central character would however be the
political equation and the political interests of the rulers.
Kamduni judgement is classic case of hoodwinking the public- the rulers always
take the people for granted and consider them as nincompoops, that can easily
be moulded. When the Public prosecutor wanted hanging by death for all the six,
the judge divided the group in equal division and convicted the first group
with death penalty by hanging and the second group with life-imprisonment [the number
of years is not clearly defined in Bengal]. This is a clear loophole inserted
deliberately so that there is a way-out left to bring down the death-by-hanging
to the life-imprisonment after more than a few years of silence where the
conduct of these convicts, willingly adjudged good, friendly and conducive will
be pleaded against their death on compassionate ground and reduce the
fierceness of the judgement. This is a very usual practice. During this interregnum
these convicts will be treated royally within judicial custody where they will
enjoy royal treatment – they will demand anything they want for their lunch and
dinner and the government is bound to provide that, their kin will have free
visitation right, they will have even facilities to keep mobiles and TVs in
their cells, even their wives can have approved conjugal stay in their cells.
They will earn a wage without any single work load. This money will then be
passed on to their kin. This is our law….. the intricacies never come out even
from the so called human rights organisations- they conveniently take upon
themselves the role of a moral judge without knowing the basic facts.
I and many of friends of mine oppose `death penalty` for this very
reason, and not from any stale compassionate or `moral` ground! Devil lies in
the detail.
Election campaign
Kamduni judgement is a clear election stance. The timing is so
appropriately chosen. The appeal to the high court will be at least six months
later crossing the election time. High court after long deliberations will maintain
the same conviction [on technical grounds]… There would be , after a long
interlace, a hearing in the Supreme court and that court will hear the case
right from the beginning, the case will be published campaigned to make a
national case. The court will then modify the judgement a little bit making it
less venomous and that would show the way-out more clearly. Then the case will
await President’s approval … that is a plain and sample political decision and
will be effected on appropriate moments and the then political exigency. All
this ostensibly could be done within 2019 LS election or if needed before 2021
Assembly election of WB. The outcome will be decided on the then relationship
of the central and state government. A very known and usual path that we have
seen repeatedly! Some times and quite often villains are heroes when politics
writes the scripts!
When it will be used?
This is another weapon now, that
will be used in every crises of the national politics to show that the justice
system is so fair, elaborate and process driven. One very important human
rights campaigner, who was once a leftist and now avowedly Gandhian and
actually toying the line of the ruling party in the garb of liberalism once
said that all other forms of judgement [he meant people’s courts] are kangaroo
ones as if this systematic ones are bequeathed by God through His Natural laws-
if there is any kangaroo-ity anywhere it is in this ruling feudo-capitalist
system of marginalising and manipulating peoples’ voices and aspirations!.
Kamduni is thus a permanent weapon in the hands of rulers to quell any peoples’
movement- all these in ‘un-deliberate’ and ‘naïve heart calls’ by the
liberalism of the human rights organizations…. This is how these ‘interest
groups’ and ‘partial pressure groups’ aid the rulers … had been doing so and
would keep on doing so….that is how Lenin’s caution is again becoming true…
that every move by the rulers is actually to quell peoples’ desires and
initiative… we have to be figure out the real hidden agenda… This is the
process methodology of how to turn peoples’ aspirations into a weapon of mass
marginalisation and mass deprivation…
Just before the election the opposition looses an issue, the ruling
party gains one- a very important one, this again will be touted that no
similar moves were undertaken in the previous 34 years and only this regime can
show how to ‘correct’ their own mistakes and the errand cadres, and establish
justice only if and as long as the people learns how to wait. . What a
wonderful timing! Just 15 days before the election notification might be made
public!
Where revisionists fail, revolution dares!
Revisionists and individualists reinforce the armoury of the rulers- the
way is clear, but the rulers fright when a Kashmiri Women sits down in hunger strike
within a police station for a cause that stemmed out of a Dalit suicide
[systemic murder to be precise], who joins another Dalit communist student
leader from the flaming fields of Bhojpur, and the conscious minds of Delhi…
that is the alternative discourse to the revisionist sham opposition of Kamduni
and the human rights organizations’ disoriented naivete… This is the
revolutionism countering revisionism.. What a wonderful time? A tale of two
methods, one rickety, counterproductive, vacuous, the other is effective,
silent swift and piercing the all subterfuges!
The future!
Kamduni judgement is now a weapon… will be used time and again … to save
the rulers…. Till such time we sincerely pierce the bubble…. Not simply through
verbal or literary exposure but through appropriate measures and street
protests! Let us posit Rohith Vemulla protest against Kamduni judgement and
tell the rulers …. they have lost!
